Public Fraud Indictment
The Supreme Court ruled that the indictment against the defendant for public fraud was flawed, as it failed to show the fraud targeted the public or that the false information was publicly accessible, as required by law. However, using its authority under Section 195(2) of the Criminal Procedure Code, the Court reclassified the offense as standard fraud under Section 341 of the Criminal Code and computer fraud under Section 14(2) of the Computer Crime Act, to which the defendant had confessed. The Court also clarified that separate fraudulent acts, even if part of one transaction, can be treated as multiple offenses.
